1. Agreement to Terms

By accessing or using the Athyx website, mobile application, or purchasing our products, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our services.

3. Products & Orders

All products are subject to availability. We reserve the right to limit quantities or discontinue any product at any time. Prices are subject to change without notice. We reserve the right to refuse or cancel any order at our discretion.

4. Payment

Payment must be received prior to shipment. We accept major credit cards and other payment methods as displayed at checkout. All transactions are processed securely.

5. Shipping & Delivery

Athyx offers free standard shipping on all orders. Orders are typically dispatched within 3–5 business days. Shipping availability and eligibility may vary by destination and is determined solely at our discretion. Athyx reserves the right to restrict or decline shipments to certain regions or countries at any time. Athyx is not responsible for delays caused by carriers, customs, or events outside our control. Risk of loss passes to you upon delivery to the carrier.

International orders may be subject to import duties, taxes, and customs fees imposed by the destination country. These charges are the responsibility of the customer and are not included in the product price or shipping cost.

6. Returns & Refunds

We offer a 30-day return policy for unused items in original condition. To initiate a return, contact us at hi@athyx.com. Refunds are processed within 5–10 business days of receiving the returned item.

Return shipping fees are the responsibility of the customer. Any customs duties or taxes paid on the original shipment are non-refundable.

7. Intellectual Property

All content on this site — including text, graphics, logos, and software — is the property of Athyx, Inc. and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

8. Disclaimer of Warranties

Our products and services are provided "as is" without warranties of any kind, either express or implied, including but not limited to fitness for a particular purpose or non-infringement. Biometric data from Athyx wearables is intended for informational purposes only and does not constitute medical advice.

9. Limitation of Liability

To the fullest extent permitted by law, Athyx, Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our products or services.

10. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.

11. Changes to Terms

We may update these Terms at any time. Continued use of our services after changes constitutes acceptance of the revised Terms. The effective date above reflects the most recent revision.

13. Partner Program (Affiliate / Referral)

Athyx offers a Partner Program for eligible participants, including Ambassadors, Supporters, and High Kinetic partners. Each partner receives a unique referral code providing a 10% discount to customers who use it at checkout.

Partners earn a commission equal to 100% of the discount amount used by referred customers. Commissions are paid as cash back to the partner.

Earnings are calculated on a monthly basis and carry over from previous months until withdrawn. A minimum balance of $100 is required before a withdrawal can be initiated; balances below the threshold remain in the partner's account and accrue month over month.

Payouts are processed exclusively through Stripe. To receive a payout, the partner must create and verify a Stripe Connect account through the link provided in their Athyx account. Stripe is the sole payout method — no other channels (wire, PayPal, crypto, check, etc.) are supported, without exception.

Athyx reserves the right to modify, suspend, or terminate the Partner Program — or any individual partner's participation — at its sole discretion and without prior notice.

Material changes to payout structure, commission rates, or program terms will be reflected in updated program terms published on this page. Continued participation in the Partner Program after such changes constitutes acceptance of the revised terms.

14. Medical Disclaimer

Athyx products and services are intended solely for fitness, training, and athletic performance purposes. They are not medical devices and are not intended to diagnose, treat, cure, monitor, or prevent any disease or medical condition.

All measurements, data, and insights provided by Athyx are estimates generated through algorithms and sensors and may not be accurate or suitable for clinical use. They should not be relied upon for medical decisions.

You should not use Athyx as a substitute for professional medical advice, diagnosis, or treatment. If you have any health concerns, consult a qualified healthcare professional.

By using Athyx products and services, you acknowledge and agree that all use is at your own risk.
